Andrew Gibbons is a regulatory and transactional attorney in the areas of energy law, environmental law, and natural resources law and corporate transactions. Andrew’s practice focuses on energy regulatory matters, energy transactional matters, environmental permitting and compliance, and natural resource matters.
Andrew regularly represents utilities, developers, independent power producers and other stakeholders in energy regulatory and contested case proceedings before state public utilities commissions. Andrew has significant experience in regulatory matters related to renewable energy facilities, including the permitting of wind (onshore and offshore) and utility-scale solar projects, and compliance with community solar garden programs.
Andrew also represents clients in transactional matters related to energy generation and transmission facilities. Andrew has represented clients in numerous acquisitions, divestitures, and financings of renewable and conventional generation facilities. Andrew also represents project developers and independent power producers on project development contracting, including power purchase agreements (PPA), interconnection agreements, engineering procurement and construction (EPC) agreements, equipment warranties, turbine supply agreements, fuel supply agreements, lease agreements, subscription agreements, and joint venture or joint development agreements.
Environmental and Natural Resources
Andrew advises clients on state and federal environmental permitting and compliance associated with large infrastructure projects including conventional and renewable generation facilities, electric transmission facilities, oil and gas pipelines, mining and mineral exploration operations, and transportation facilities. Andrew regularly engages with federal and state agencies such as the U.S. Forest Service (USFS), Bureau of Land Management (BLM), Army Corps of Engineers (USACE), U.S. Fish and Wildlife Service (USFWS), Department of Natural Resources (DNR), Department of Health, Department of Commerce (DOC), Pollution Control Agency (PCA), and others. Andrew advises on permitting and compliance related to the Clean Water Act (CWA), Clean Air Act (CAA), Endangered Species Act (ESA), National Historic Preservation Act (NHPA), National Environmental Policy Act (NEPA), Federal Land Policy and Management Act (FLPMA), and other state and federal environmental statutes.
Andrew also counsels mining clients on a variety of state and federal regulatory matters related to mining and mineral exploration throughout the United States, including federal, state, and private mineral rights arrangements, and project development and permitting.
