Don Campbell is an attorney practicing in the areas of commercial and finance lease disputes, financial services and life and health insurance litigation, insurance coverage, product liability and tort litigation (including personal injury and toxic tort [asbestos] defense), transportation litigation (rail, air, trucking and pipeline), and oil and gas litigation. As part of his nationwide practice, Don has served as first-chair counsel on multiple bench and jury trials, arbitrations and appellate arguments. Don also serves as a certified neutral in mediations and has been appointed to serve as a surrogate tribal court judge.
Finance & Insurance Litigation Don’s finance and insurance litigation practice largely consists of representation of equipment finance lessors in all manners of disputes, and Don has been a member of the Equipment Leasing & Finance Association (ELFA) as well as representation of national life insurance and annuity companies in litigation related to the sale of their products. Health Insurance Litigation Don regularly handles ERISA and non-ERISA disputes for group health plans and their third party administrators. This practice includes all manners of coverage and benefit disputes as well as disputes with providers. Product Liability and Tort Litigation Don’s product liability practice includes the trial of defective product claims and counsel to manufacturers on product warranty issues, and responses to the Consumer Product Safety Commission (CPSC). Transportation Litigation Don serves as outside litigation counsel and litigation manager for a group of short line railroads, is a member of the American Short Line & Regional Railroad Association (ASLRRA) General Counsel Committee, and has presented to railroad trade associations on various liability issues. Additionally, Don has litigated and advised on trucking industry, pipeline and airline matters. Oil & Gas Litigation Having previously practiced in western North Dakota, Don has been involved in providing litigation support to the firm’s oil and gas practice. This practice has included royalty and lease disputes as well assistance to oil company exploration and production activities.
