As a member of the firm’s Business Litigation division, Nicole S. Zellweger represents a wide array of businesses and individuals in civil and commercial litigation and arbitration. She concentrates her practice in the areas of franchise and distribution law and trust and estate law.
For over ten years, Nicole has counseled both franchisors and franchisees in all aspects of their business and litigation needs. On the transactional side, Nicole’s experience ranges from drafting franchise agreements to advising potential franchisees regarding franchise documents. She also represents franchisors and franchisees in litigation and arbitration when disputes arise between them or with third parties. Additionally, Nicole has experience obtaining and defeating injunctions in this area of law and other fields, including employment litigation. She has had success in appeals before the Missouri Court of Appeals and the United States Court of Appeals for the Third and Eighth Circuits.
Nicole also focuses her practice in the field of trust and estate law. She has experience representing trustees in administration of trusts, personal representatives in the administration of wills, and both in lawsuits filed by or against them in their fiduciary capacities. Nicole's trust, estate, and fiduciary-related litigation experience includes maintaining actions to construe and modify/reform trusts, defending corporate fiduciaries against claims of fraud, negligence, and breach of fiduciary duty, and investigating fiduciary misconduct.
Nicole is a member of the firm's Property Tax Issues and Valuation Appeals group, which assists clients with all aspects of their property tax issues, including those property owners interested in property tax assessment appeals. Nicole has successfully appealed the appraised values of commercial and residential properties for owners in the City of St. Louis, St. Louis and St. Charles Counties, and surrounding counties.
