Navigating OSHA's Updated COVID-19 Guidance and Emergency Temporary Standard
On June 10, OSHA announced two significant actions in its COVID-19 response: an Emergency Temporary Standard (ETS) for healthcare facilities and updated COVID-19 safe workplace guidance for non-healthcare employers. Both actions constituted a significant evolution of OSHA's position on fully vaccinated employees.
While employers are generally happy for an update consistent with CDC recommendations, there is significant nuance to the guidance and fast-turnaround deadlines in the ETS with which employers must contend. In addition, employers are facing a patchwork of pending and enacted state legislation, along with the practicalities of implementing COVID-19 protocols consistent with the updated guidance and standards.
