Alexander Barrett Successful in Bid Protests Involving Missouri Department of Revenue
Stinson LLP attorney Alexander Barrett recently prevailed in bid protests on behalf of firm clients regarding contracts to operate Department of Motor Vehicle offices for the Missouri Department of Revenue (DOR).
Barrett protested two contract awards, contending that the DOR incorrectly applied its own bidding requirements, which did not allow bidders organized as general business corporations to qualify for certain points allotted during the bidding process. In the protest, Barrett emphasized the inconsistency of the DOR's application of such requirements and noted that his clients would have been awarded the contracts had the DOR maintained its own standards.
Bid protests ask the agency involved to conclude that it made an error, thus they rarely succeed. Nonetheless, after a thorough review, the DOR sustained Barrett's protest, cancelled the contract awards and agreed to re-bid the contracts after clarifying its bid documents. This will permit the clients to compete for the contracts on fair terms.
