Antitrust Attorneys Detail What to Expect in 2025 for Antitrust Litigation, Trends in Bloomberg Law
Stinson LLP Partners Jeetander Dulani and Nicci Warr and attorney Emily Asp authored a column for Bloomberg Law, "Antitrust Litigation Is Likely to Match the Biden Era's Pacing."
The attorneys examine the evolving antitrust landscape in the wake of a second Trump administration. They highlight ongoing cases against major tech companies, including Amazon, Apple, Google and Meta, and emphasize that these cases are expected to continue, even amid shifts in federal enforcement priorities. The attorneys also explore the growing interests and influence of state attorneys general in pursuing monopolization and merger challenges, which they note could lead to significant changes in antitrust doctrine. The impact of emerging theories and policies related to diversity, equity and inclusion and environmental, social and governance matters on competition are also addressed.
"The outcomes and remedies that result will likely reshape antitrust doctrine beyond the tech industry," the attorneys write. "Successful theories are expected to lead to an increase in antitrust litigation by governments, both state and federal, as well as private parties."
Asp has significant experience in all phases of litigation, including discovery and motions practice in state and federal court. She brings a collaborative and forward-thinking approach to each matter while keeping client service top of mind.
Dulani's practice includes competition disputes, class actions, mergers and acquisitions, government investigations and other complex litigation. He represents clients before the Department of Justice and Federal Trade Commission in merger and conduct investigations, as well as False Claims Act-related litigation, and advises on antitrust risk and compliance and on vertical business arrangements.
Warr's experience working on complex litigation and counseling matters spanning antitrust, consumer protection laws and intellectual property issues gives her a unique perspective that helps her find effective and efficient solutions for her clients. Much of Warr's work focuses on new and emerging technologies and matters involving the intersection of intellectual property and antitrust law.
