Overview
Colin litigates construction, commercial and insurance disputes on behalf of general contractors, subcontractors, developers, suppliers and landowners. He develops and executes tailored discovery and trial strategies for each client, collaborating with industry experts to achieve optimal outcomes, whether pursuing or defending claims.
Beyond litigation, Colin helps clients protect their interests and bottom line through arbitration and other alternative dispute resolution methods. He also drafts, reviews and negotiates prime agreements, lien waivers and other construction-related documents to mitigate risk and prevent disputes.
Colin has significant experience handling mechanic's lien claims in Missouri and Kansas. He successfully pursued and resolved numerous lien disputes, including a large-scale matter where he secured full payment plus attorney's fees and interest for his client by strategically placing a lien on an entire platted development of 84 distinct parcels.
Colin's deep industry knowledge allows him to effectively navigate complex issues and assist his clients with expanding their business. His background as in-house counsel and project manager for a local asphalt and construction firm gives him a valuable perspective and insight into daily activities and pressures.
Experience
Secured a jury verdict of over $2.5 million at the end of a multi-week trial concerning claims of breach of the implied covenant of good faith and fair dealing, breach of lease agreement, affirmative fraud, negligent misrepresentation, fraud by silence, unjust enrichment and civil conspiracy against multiple defendants.
Defended claims for breach of contract and fraud against the former owner and seller of the 909 Walnut property in downtown Kansas City, Missouri. Achieved a complete defense verdict on all claims presented at the bench trial and received a judgment of nearly $400,000 for incurred attorney's fees.
