Kadee is dedicated to solving legal challenges in the areas of ERISA and medical, disability and life benefits litigation, insurance litigation, and business and commercial litigation.

Overview

Kadee defends insurers, third-party administrators and sponsors of employee welfare benefit plans in ERISA litigation in federal courts across the country. She has defended claims related to medical, disability and life benefits. Kadee has successfully defended clients in both ERISA denial of benefits claims and breach of fiduciary duty claims. She has also represented clients in claims under the Mental Health Parity and Addiction Equity Act.

Kadee has also successfully defended claims against Medicaid Managed Care Organizations and Medicare Part C Insurers.

Kadee has defended insurers against breach of contract, bad faith, vexatious refusal and other state law claims related to denial of insurance benefits under policies not governed by ERISA, such as policies purchased on the Health Insurance Marketplace, short-term medical and accident indemnity policies. She has also represented clients in matters dealing with stop-loss insurance coverage issues and both insurers and health care providers in disputes over payment of medical claims under direct provider agreements and provider network access agreements.

Additionally, Kadee is deeply committed to upholding the firm's tradition of pro bono legal service, devoting significant time to assisting clients with immigration law and insurance litigation.

Before attending law school, Kadee worked in the nursing field. She is able to leverage her nursing background along with her notable experience as a litigator to best serve clients in the medical, health care and insurance industries.

Experience

Kadee has obtained dismissals of claims against Medicare Part C Insurers for lack of subject matter jurisdiction and on preemption grounds.

Kadee has obtained summary judgments on behalf of clients on denial of benefits claims, both under ERISA and state law breach of contract theories.

She has defeated a motion for a temporary restraining order related to failure to cover medical claims relating to an organ transplant.
